Attendance Capture — Terms & Agreement

1. What We Provide

Kingdom Metrics will provide Attendance Capture Services for Client, using our system to count attendance at your services. This includes:

  • Image-based attendance tracking during services.
  • Secure data processing to generate attendance reports.
  • Emailed reports with attendance insights.

Attendance Accuracy Disclaimer

  • Kingdom Metrics provides attendance counts using image-based tracking technology, which is designed to be more accurate and consistent than manual counting methods.
  • Differences between Kingdom Metrics' numbers and prior attendance tracking may occur due to variations in past counting methods, and should be considered as part of the transition to a more precise attendance measurement system.

Warmup & Accuracy Calibration Period

  • Kingdom Metrics' Attendance Capture system requires a 2–6 week warmup period to calibrate attendance tracking for Client.
  • During this period, there may be higher variability in accuracy and slightly longer reporting times as the system refines its ability to count attendance accurately.
  • After the warmup period, attendance reporting will be fully automated and optimized for accuracy.

Additional Campuses

If Client wants to add another campus to Attendance Capture, Kingdom Metrics will provide service for the new location at the agreed-upon rate per location. Any additional campuses will be billed separately or added to the existing invoice.

2. Your Commitment

To ensure smooth operation, you agree to:

  • Install the necessary image sensors in your building (or allow us to do so).
  • Provide access to service schedules so we can properly track attendance.
  • Keep your billing information updated for continued service.

Client Responsibilities

Client is responsible for ensuring that image sensors remain unobstructed, powered, and connected to the network at all times. This includes keeping the area around sensors clear and notifying Kingdom Metrics promptly of any changes that could affect sensor performance.

3. Pricing & Payment

  • The cost for Attendance Capture is billed monthly at the rate displayed at checkout.
  • Monthly billing begins 40 days after purchase or 10 days after delivery of hardware to Client, whichever comes first.
  • Monthly billing will be charged automatically to the payment method on file until canceled.
  • If payment fails, we will notify you and allow a 15-day grace period before pausing service.

Installation & Equipment Costs

  • A one-time hardware fee as displayed at checkout applies per unit, which includes one image sensor and software setup.
  • If additional costs are required (e.g., extra sensors, travel for installation), Kingdom Metrics will provide a quote before installation.
  • The image sensor becomes the property of Client after purchase. If the subscription is canceled, the Client retains the image sensor, but Kingdom Metrics will no longer provide attendance tracking services.

Price Adjustments

Kingdom Metrics may adjust pricing with a 45-day notice. Any price updates will be communicated via email and will take effect on the next billing cycle after the notice period. If you do not agree to the new pricing, you may cancel your service before the new rates take effect.

Historical Data Integration

To enhance attendance reporting in the first year, Kingdom Metrics will import and analyze prior attendance data from Client's database as part of the service. After the first year, Kingdom Metrics' attendance tracking will provide year-over-year comparisons without the need for historical data imports.

4. Marketing & Branding Usage

By signing up for Kingdom Metrics' Attendance Capture, Client grants Kingdom Metrics permission to use the Client's name and logo on our website and promotional materials to indicate that you are a Kingdom Metrics client. If you prefer to opt out of this, simply email us at [email protected] at any time.

5. Privacy & Data Protection

  • Attendance data is used only for reporting purposes and will not be shared or sold.
  • All data is processed securely in accordance with our Privacy Policy.
  • No personally identifiable information (PII) is collected from individuals in attendance.

Service Availability & Technical Issues

  • Kingdom Metrics aims to provide accurate attendance tracking with minimal interruptions. However, service availability may be impacted by onsite factors beyond our control, including internet outages, power failures, or physical obstructions to image sensors.
  • If a technical issue prevents attendance tracking for a service, Kingdom Metrics will make reasonable efforts to assist in diagnosing the issue and restoring service. However, Kingdom Metrics is not responsible for outages caused by onsite conditions.
  • In the event of a system-related failure on Kingdom Metrics' end, we will work promptly to restore functionality. Attendance reports may be unavailable for affected services, but no refunds or credits will be issued for temporary disruptions.

Data Security

Kingdom Metrics is committed to maintaining the confidentiality and security of all collected attendance data. Data is processed securely, and no personally identifiable information (PII) is collected or stored. Kingdom Metrics will not share or sell attendance data to third parties.

6. Ending the Service

Client may cancel at any time by providing at least 14 days' notice before the next billing date. Service will continue until the end of the paid period, and no partial-month refunds will be issued after a billing cycle has started.

7. Limitation of Liability

Kingdom Metrics shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Attendance Capture service. In no event shall Kingdom Metrics' total liability exceed the amount paid by Client for services in the previous 2 months.

8. Dispute Resolution

Any disputes arising from this agreement will be resolved through mediation. If mediation is unsuccessful, the parties agree to submit to binding arbitration in Palm Beach County, Florida in accordance with Florida law. Each party will bear its own costs for dispute resolution.

By moving forward with Kingdom Metrics' Attendance Capture, Client agrees to these terms.
